1. Introduction

These Terms of Use govern your access to and use of the DaarByt website and services. By creating an account, making a booking, listing a location, or otherwise using DaarByt, you agree to these terms. If you do not agree, please do not use the platform.

2. About DaarByt

DaarByt is a sole proprietorship established in the Republic of South Africa. We operate an online marketplace that connects anglers with independent location owners across South Africa.

DaarByt provides the platform for discovery, booking, and payment. We are not the operator of any location listed on the platform. Your experience at a location is a matter between you and the location owner.

3. Definitions

• Platform - the DaarByt website and related services.
• Angler (or guest) - a person who searches for locations and makes bookings.
• Owner - a person or business that lists and manages a location on DaarByt.
• Location - a dam, campsite, lodge, or related fishing place listed on the platform.
• Listing - the information an owner publishes about their location, including pricing, rules, and availability.
• Booking - a stay at a location arranged through DaarByt.

4. Eligibility

You must be at least 18 years old to use DaarByt. You agree to provide accurate information when registering and to keep your account details up to date. Email verification is required before you can sign in.

You are responsible for keeping your password secure and for all activity on your account.

5. Accounts

Your account may include your name, email address, and optional date of birth. You must provide accurate information. Each person may hold only one account.

We may suspend or terminate accounts that violate these terms, misuse the platform, or pose a risk to other users.

6. Location listings

Owners are responsible for the accuracy and completeness of their listings, including descriptions, pricing, rules, photos, availability, and contact details.

Owners must ensure their locations comply with applicable fishing regulations, permits, and local laws. Owners who offer bookings exclusively through DaarByt must honour bookings made on the platform. Owners who also accept bookings elsewhere are responsible for managing availability across all channels.

7. Bookings

Anglers submit booking requests through the platform. Location owners review and approve or decline requests. Payment is required to confirm a booking once approved.

Some locations may accept bookings automatically when there is availability. A booking is not guaranteed until it is confirmed. Requests may expire or be declined by the owner.

8. Payments

All prices are displayed in South African Rand (ZAR) and are set by location owners. Payments are processed through Paystack, a third-party payment provider. DaarByt facilitates payment from anglers to owners' connected payout accounts. Owners must provide accurate payout and account-holder details. Bank accounts are verified through Paystack before payouts are enabled.

Bookings that are not paid may be cancelled. DaarByt is not responsible for payment processing errors or delays caused by Paystack or your bank.

9. Cancellations and refunds

Both anglers and owners may cancel bookings, depending on the stage of the booking (for example, before or after payment, or before or after confirmation). See our Refund Policy for details.

Where a refund applies, it is processed according to the payment provider's rules and may take time to appear in your account. DaarByt does not guarantee refund outcomes for disputes between anglers and owners.

10. User conduct

You agree not to:

• Use the platform for fraudulent or unlawful purposes
• Provide false or misleading information in your account or listings
• Harass, abuse, or threaten other users
• Scrape, copy, or misuse platform content or data
• Circumvent platform payments for locations that book exclusively through DaarByt

11. Intellectual property

The DaarByt name, logo, website design, and platform software are owned by DaarByt. You may not use our branding without written permission.

Owners retain ownership of their listing content (photos, descriptions, and rules) and grant DaarByt a licence to display that content on the platform for the purpose of operating the service.

12. Third-party services

DaarByt uses third-party services including Paystack for payments, an email provider for transactional messages, and embedded maps. These services have their own terms and privacy policies, which apply when you interact with them.

13. Disclaimers

Fishing and outdoor activities carry inherent risks. Location conditions, water levels, weather, and fish populations can change without notice. DaarByt does not guarantee fishing success or specific location conditions.

For locations that also accept bookings outside DaarByt, any arrangements made directly with the owner are between you and the owner. We do not warrant that the platform will be uninterrupted or error-free.

14. Limitation of liability

DaarByt is a booking platform, not a location operator. To the extent permitted by South African law, DaarByt is not liable for listing inaccuracies, location conditions, fishing outcomes, the conduct of owners or anglers, failures of third-party services (including Paystack and map providers), or any indirect or consequential loss arising from your use of the platform.

15. Indemnity

If your breach of these terms, false or misleading listing, or unlawful conduct causes DaarByt to face a claim, demand, or loss, you agree to indemnify and hold DaarByt harmless against reasonable costs and damages arising from it.

16. Privacy

Your personal information is handled as described in our Privacy Policy.

17. Changes to these terms

We may update these terms from time to time. When we make material changes, we will note the updated date on this page. Continued use of DaarByt after changes take effect constitutes your acceptance of the revised terms.

18. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.
